The agreement between you and ServeAxis Technology LLC for use of the Servd platform.

1. Acceptance
By creating an account or using Servd, you agree to these Terms. If you are using Servd for a law firm, business, or other entity, you represent that you have authority to bind that entity. Capitalized terms used and not defined here have the meanings in our Privacy Policy and DPA.
2. What Servd is and isn't
Servd is a software platform for managing process serving, skip trace, and related field operations. Servd is not a law firm, does not give legal advice, and does not represent any party. The AI features assist with operations and document preparation; they do not substitute for the judgment of a licensed attorney. You are responsible for confirming that any service-of-process method you select is appropriate for your case + jurisdiction.
3. Account + acceptable use
- You must be 18 or older and able to enter into binding contracts.
- You must provide accurate information about parties, addresses, and cases.
- You must not use Servd for mass scraping of court records, automated unauthorized practice of law, illegal service of process, or harassment. See our Acceptable Use Policy.
- You are responsible for activity under your account; promptly notify us of any unauthorized use.
4. Process servers
Process servers are independent contractors, not Servd employees. They are vetted, background-checked, license-verified, and insured per our published standards, but Servd does not guarantee any particular outcome. Service is attempted in good faith following the applicable state's rules.
5. Payment + refunds
Pricing is shown at the time of quote. We bill at the time of order via Square. Refunds follow our Refund Policy. Disputes raised more than 60 days after charge fall under Square's dispute mechanism.
6. AI features and disclaimers
The AI features — chat assistant, document parsing, dispatch suggestions, affidavit drafting, jurisdiction lookup — are operational assistance, not legal advice. Outputs may contain errors. A human reviewer checks every affidavit before signing, but you are ultimately responsible for verifying that documents and service comply with the rules of your court. We do not use your case data to train foundation models. AI providers process your data only on our instructions per the contracts referenced in our DPA.
7. Intellectual property
You retain all rights to the case data and documents you upload. You grant Servd a limited license to use that data to operate the platform for you. We retain all rights in the Servd platform, brand, code, and trained AI evaluation data (not foundation model weights — we don't train those).
8. Confidentiality
We treat your case data and communications as confidential. Our internal access is least-privilege + audit-logged. Servers see only the data they need for the assigned case.
9. Term + termination
These Terms apply for as long as you use Servd. Either party may end the relationship at any time. Some clauses (payment of fees already due, IP, indemnity, limits of liability, confidentiality, governing law) survive termination.
10. Indemnity
You agree to indemnify Servd against third-party claims arising from your use of the platform in violation of these Terms or applicable law, or from incorrect or unauthorized case data you uploaded.
11. Disclaimers + limits of liability
SERVD IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF $500 OR THE FEES YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM. NEITHER PARTY IS LIABLE FOR CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES.
12. Dispute resolution
Disputes are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Both parties consent to the exclusive jurisdiction of the state and federal courts in San Francisco County, California. Either party may seek emergency equitable relief in any court of competent jurisdiction.
13. Changes
We may update these Terms; material changes will be posted here and announced. Continued use of Servd after a change constitutes acceptance.
